TERMS OF SALES
Wandeful Life offers coliving accommodation to transient customers who do not take up residence there. The coliving activity is characterized by the pooling of spaces allocated to community life and shared between customers.
By subscribing to the accommodation offer offered by Wanderful Life, the customer has, during the rental days, a private space, as well as access to common areas, namely a lounge, a spa, a ” outdoor room” as well as the services included and described on the website.
Before signing the accommodation offer offered by Wanderful Life, the Customer reads these general conditions.
ARTICLE 1 – DEFINITIONS
The Customer: refers to any customer purchasing accommodation and inclusive services from Wanderful Life.
The Offer: means the accommodation offer made to the Client by Wanderful Life. The Offer includes the essential elements of the accommodation, namely the designation of the room and the reservation period, as well as the rental price, services included.
Coliving: refers to the concept proposed by Wanderful Life, namely the rental of accommodation in a single room with the pooling of spaces allocated to community living and shared between Customers.
ARTICLE 2 – SCOPE
These General Terms and Conditions apply to any Customer who has subscribed to an Accommodation Offer offered by Wanderful Life. The validation of a reservation implies full and unreserved acceptance by the Customer of these General Conditions.
The said General Conditions apply for the entire duration of their online publication and may be modified and/or supplemented by Wanderful Life at any time.
ARTICLE 3 – PARTICULARITY OF ACCOMMODATION IN COLIVING
Any rental is concluded as a temporary residence. The Customer may not practice any commercial, craft or professional activity there (the Customer being only authorized to use the coworking spaces provided but may not in any case receive his customers).
The Customer may not rely on the legal provisions applicable to residential leases, in particular with regard to staying in the premises. Consequently, the reservation is governed by the provisions of the Civil Code as well as by these General Conditions.
ARTICLE 4 – RESERVATIONS AND MEANS OF PAYMENT
Reservations can be made on the site: www.wanderfullife.fr, by telephone, by e-mail, by specialized site or by mail. The reservation will only be effective if the latter is guaranteed by the customer, either by communicating a credit card number with expiry date or by payment of a deposit, and after receipt of a detailed reservation confirmation. Payment for all services will be made directly to Wanderful Life (exceptions made for reservations prepaid at the time of reservation). The possible balance as well as all the additional services purchased by the customer must be paid by the customer before leaving Wanderful Life. Wanderful Life reserves the right to refuse any reservation in the event that the credit card number is incorrect or the reservation is incomplete. Reservations regardless of their origins will be payable in €uro only. LWanderful Life accepts the following credit cards: Visa, Mastercard and American Express, and has a secure reservation system (SSL) that protects and encrypts all sensitive data transmitted to the reservation in order to prevent any disclosure to a third party. When registering the reservation, a credit card debit authorization will be made. This will be done for informational purposes, and will in no way be a debit from the account except in the following cases:
– “Non-cancellable – non-refundable” promotional offer.
– If the validity date of the credit card is prior to the date of arrival.
The customer is solely responsible for his choice of services and their suitability for his needs, so that Wanderful Life cannot be held liable in this regard.
The establishment also accepts holiday vouchers.
ARTICLE 5 – CONDITIONS FOR MODIFICATION OR CANCELLATION OF THE RESERVATION OF ROOMS BY THE CUSTOMER
The possibilities of modifying the reservation are limited. Any request for modification or cancellation of the reservation, whether total or partial, must be expressed in writing, 7 days before the day of the first night reserved by the Customer. firstname.lastname@example.org
• Changes between the date of signature and D-7*
The Customer is granted a cancellation margin free of charge and with reimbursement of the deposit.
• Changes after D-7*
In the case of a cancellation by the Customer 7 days before and until the day of arrival and whatever the cause,
the total amount of the reservation paid by the Customer is retained in full by Wanderful Life without the possibility of reimbursement or postponement.
*D= the first night reserved by the Customer.
5.2 CUSTOMER NO SHOW
In the event of a Customer’s “no-show”, delayed arrival or early departure, for whatever reason, Wanderful Life will invoice the Customer for the full accommodation service due, for the entire stay. . No complaint can be made by the Customer.
ARTICLE 6 – PAYMENT OF THE PRICE
The price is indicated in euros all taxes included.
The amount of the reservation deposit is deducted from the amount remaining to be paid.
For any reservation of less than 30 days, the entire stay is paid for by the Customer on the day of his arrival and before the keys to his personal space are handed over.
The prices indicated are in €uro and include VAT, and take into account the VAT applicable on the day of the reservation. Any change in the applicable rate, or any modification or introduction of new legal taxes introduced by the competent authorities, will be automatically passed on to the prices indicated on the date of invoicing.
Rates are per room for the number of people indicated and according to the period selected and do not include services (unless otherwise stated)
The tourist tax of €2.40 for the year 2023 per day and per person (over 18 years old) is not included in the price displayed and must be paid directly on site. It applies all year round.
Some services may be subject to a supplement and may be subject to possible modifications without notice, in no way engaging the responsibility of Wanderful Life.
No stay booked before the establishment of a possible promotional offer (non-refundable rate) will be subject to reimbursement, even partial.
ARTICLE 7 – EXCEPTIONAL CIRCUMSTANCES – FORCE MAJEURE
7.1 EXCEPTIONAL CIRCUMSTANCES PREVENTING WANDERFUL LIFE FROM PERFORMING ITS OBLIGATIONS
Wanderful Life is exonerated from any responsibility if it is unable to execute all or part of the reservation due to a fortuitous event, due to a third party or a case of force majeure.
Are particularly considered as cases of force majeure within the meaning of this article: social and labor disputes, strikes, wars, riots, epidemic, health crisis, as well as fire, flood, earthquake and any other natural disaster.
7.2 EXCEPTIONAL CIRCUMSTANCES LEADING TO THE POSTPONEMENT OR CANCELLATION OF THE CLIENT’S RESERVATION
If the reservation cannot be held on the date initially scheduled due to a case of force majeure or other exceptional circumstances, the Customer may ask Wanderful Life to postpone their reservation to new dates. In this case, Wanderful Life undertakes to make its best efforts to postpone the commitments made by the Clients to the new dates under equivalent conditions.
Any cancellation of reservation by the Customer outside the cases mentioned above will be subject to the cancellation conditions referred to in Article 5 of the General Conditions.
ARTICLE 8 – CUSTOMER COMMITMENT
The Client is bound by the following main obligations:
to pay the price of accommodation;
to respect the reception capacity of the residence;
to use the premises peacefully;
to answer for damage and losses that occur during the duration of the stay in the premises of which he has the exclusive enjoyment, unless he proves that they occurred by force majeure, by the fault of Wanderful Life or by the fact of a third party that he did not introduce;
to report without delay to Wanderful Life any malfunction, any deterioration whatever the cause;
refrain from carrying out any commercial, craft or professional activity there and from lending or subletting the premises, under any pretext whatsoever, even free of charge; the Customer acknowledging that this rental was only granted to him as a temporary and recreational residence, a condition without which this commitment would not have taken place.
Wanderful Life will be entitled to claim from the Customer upon departure:
the total value, at the replacement price, of any furniture and equipment that is broken, cracked or chipped or simply deteriorated and of those whose wear and tear would exceed normal for the duration of the rental;
cleaning of dirty and stained blankets or duvets;
compensation for damage of any kind concerning papers, paints, draperies, parquet floors, ceilings, rugs or carpets, windows, bedding, etc.
The Customer undertakes not to invite any person whose behavior is likely to harm the establishment, the latter reserving the right to intervene if necessary.
The Customer waives all recourse against Wanderful Life:
– in the event of theft, burglary or any tortious or criminal act
committed in the sublet premises or in the common areas of the building, – in the event of an interruption in the service of water, gas or electricity, telecommunications, heating or hot water , as in the event of even prolonged stoppage of the operation of the lift(s) if any, or of any other item of equipment, – in the event that the premises should be destroyed in whole or in part, or expropriated, – in in the event of disturbance or damage suffered by the occupants of the building or any other, – in the event of non-replacement of furniture or equipment or in the event that the lessee comes to consider that the conditions of comfort have diminished.
ARTICLE 9 – RIGHT OF WITHDRAWAL
In accordance with article L 221-28 of the Consumer Code, the Customer does not have the right of withdrawal provided for in article L 221-18 of the Consumer Code, given the nature of the services provided.
The contract is therefore concluded definitively as soon as the reservation is made by the Customer according to the methods specified in the
these Terms and Conditions.
ARTICLE 10 – ARRIVAL AND DEPARTURE
The keys are handed over during opening hours, from 3 p.m. on the day of arrival. They must be returned before 12 noon on the day of departure. It is the Customer’s responsibility to check the opening hours when booking and, if necessary, to notify Wanderful Life of an arrival or departure outside the opening hours. Wanderful Life will then make arrangements directly with the Client to communicate the procedure to be followed, which may be subject to an additional charge.
ARTICLE 11 – COMPLAINTS AND DISPUTES
In the event of a dispute, complaint or disagreement on part of the invoice, the Customer undertakes to pay the undisputed part without delay and to indicate in writing to Wanderful Life the reason and the amount of the dispute, within a period of 20 days from date of invoice.
The applicable law is French law. In the event of a dispute, and in the absence of an amicable agreement, the competent courts will be those of Albertville (73200).
The Customer is informed that he may in any case resort to conventional mediation, in particular with the Consumer Mediation Commission or to any alternative method of dispute resolution (conciliation, for example) in the event of a dispute.
ARTICLE 12 – INTERNAL RULES
The Customer must respect the rules of procedure, a paper copy of which will be displayed in his room or by QRcode.
ARTICLE 13 – MODIFICATION OF BENEFITS
If the circumstances require it, and only in the event of an event of force majeure beyond its control, Wanderful Life may be obliged to partially or totally modify the included and optional services. Optional services not provided will not be invoiced but no compensation can be claimed.
ARTICLE 14 – INSURANCE – DAMAGE – BREAKAGE – THEFT
The Customer will be responsible for taking out any insurance policy (damage – civil liability) that he deems necessary.
The Customer is in particular invited to take out specific insurance in the event of the presence of large equipment or valuable goods insofar as Wanderful Life cannot be held liable in the event of deterioration or theft of said goods.
The Customer is responsible for all damage caused by his intermediary and undertakes, in the event of deterioration of the premises made available, to bear the costs of restoring the said premises. Under no circumstances can Wanderful Life be held liable for damage of any nature whatsoever, in particular fire or theft, likely to affect the objects or equipment deposited by the Customer during the execution of these presents. `
ARTICLE 15 – PERSONAL DATA
By booking accommodation, the data collected is processed by Wanderful Life. This data is necessary to manage the reservation and may be used to better know the Customer and send him information on Wanderful Life’s products and services.
In the absence of information, Wanderful Life will not be able to register a reservation. The data is intended for Wanderful Life, as well as service providers, for the purposes of commercial management of reservations, invoicing, payment, prospecting and commercial promotion/animation, commercial statistics and satisfaction surveys. In accordance with the legal provisions, you have a right of access, interrogation, rectification, opposition with Wanderful Life as well as the right to define guidelines for the processing of your personal data.
Wanderful Life undertakes that any person it authorizes to process Personal Data is subject to an obligation of confidentiality and to enforce vis-à-vis the Client, his right of opposition for reasons relating to his particular situation, of access, rectification, erasure and limitation. In the event of a dispute, the Customer also has the right to refer the matter to the CNIL.
